Terms and Conditions
These terms and conditions (the “Agreement”) govern your use of the online course (the “Course”) hosted on Google Classroom (the “Platform”) by Mindful Art by MW and Mandy White (“we” or “us”). By accessing or using the Course, you agree to be bound by this Agreement. If you do not agree to be bound by this Agreement, you may not access or use the Course.
### 1. Registration and Payment
1.1. To access the Course, you must register and pay the course fee (the “Fee”) in accordance with the instructions provided by us.
1.2. You represent and warrant that all information provided by you in connection with your registration is true, accurate, and complete.
1.3. The Fee is non-refundable.
### 2. License
2.1. Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Course solely for your personal, non-commercial use. The lifetime of the materials is dependent upon the Course content or materials being housed on the Platform and the owners and users of the account retaining independent access. Lifetime access will be honored for the lifetime of the Course being housed on the Platform.
2.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Course content or materials, except as expressly permitted by this Agreement or as otherwise authorized by us in writing.
### 3. Intellectual Property
3.1. The Course and all content and materials included therein are protected by copyright, trademark, and other intellectual property laws and treaties.
3.2. You acknowledge and agree that we own all right, title, and interest in and to the Course, including all intellectual property rights therein.
3.3. You may not use any of our trademarks or service marks without our prior written consent.
### 4. Termination
4.1. We may terminate this Agreement at any time and for any reason, with or without notice to you.
4.2. Upon termination of this Agreement, your license to access and use the Course will immediately terminate, and you must immediately cease all use of the Course.
### 5. Disclaimers
5.1. The Course is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.
5.2. We do not warrant that the Course will meet your requirements, or that the Course will be uninterrupted, timely, secure, or error-free.
### 6. Limitation of Liability
6.1. To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with this Agreement or the Course, including but not limited to damages for lost profits, lost data, or business interruption.
6.2. In no event will our total liability to you for all damages, losses, and causes of action arising out of or in connection with this Agreement or the Course exceed the amount of the Fee paid by you for the Course.
### 7. Governing Law and Jurisdiction
7.1. This Agreement will be governed by and construed in accordance with the laws of the state of Illinois], without giving effect to any principles of conflicts of law.
7.2. Any dispute arising out of or in connection with this Agreement or the Course will be resolved exclusively in the courts of the state of Illinois.
### 8. Entire Agreement
8.1. This Agreement constitutes the entire agreement between you and us with respect to the Course and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
###9. Modifications
9.1. We may modify this Agreement at any time by posting the modified Agreement on our website. Your continued participation in the Course following such modification constitutes your acceptance of the modified Agreement.
